PFAS Litigation: An Evolving Global Disaster

The term "per- and polyfluoroalkyl substances,"
sometimes known as "PFAS," refers to a group of hazardous synthetic
chemicals that have been used in the United States since the 1940s and are
found in various consumer goods as well as our land, air, and water.
PFAS can have several effects on our bodies. When eaten,
PFAS can remain in our bodies for a long time after first coming into contact
with us. This explains why this particular group of dangerous compounds has
such severe health impacts.
The proximity of industrial sites, military installations,
and airports are where PFAS water pollution occurs most frequently. Training
exercises at US military installations and commercial airports have used
firefighting foam for many years. This foam eventually got into the water
supply. According to a Department of Defense analysis from 2020, 600 military
locations and the areas around them had PFAS water pollution.
Over the past few years, many PFAS litigations have
been filed against the manufacturers of products that contain PFAS. These PFAS
lawsuits were filed by local governments, which alleged that their water
systems were contaminated. People who allege that drinking contaminated water
caused them to get cancer or other illnesses have also filed claims.
Earlier this year, a consumer class
action lawsuit was brought against McDonald's because the renowned
fast-food company has been selling food in packaging that contains hazardous
chemicals known as PFAS. The lawsuit was filed on September 20, 2022. In this
PFAS litigation, it is alleged that McDonald's made false statements to
customers about the safety, environmental friendliness, and non-toxicity of the
food packaging for its products.
The Northern District of Illinois is where it was filed.
McDonald's opposed the plaintiff's allegations and his right to speak on behalf
of the proposed class of consumers in a request to dismiss that was submitted
over the summer. A hearing ought to be scheduled for November after the
plaintiffs presented their statement in opposition last week.
